Summary

The Ombudsman's reasoning

The car was brand new and therefore a reasonable person would expect it to be fault-free. The undisputed fault (loss of power) rendered the car of unsatisfactory quality in breach of the Consumer Rights Act (2015). Mrs T exercised her statutory right to reject the car within 30 days, which does not provide the business with an opportunity to repair. RCI should have allowed the rejection rather than arranging repairs. Mrs T's decision to stop using the car was reasonable given the safety concerns, and she had minimal use of the vehicle.
