Summary

Mr D complained that Barclaycard lent him £4,400 irresponsibly in September 2024 when his annual income was only £12,000 and he already had existing loans. Barclaycard upheld the complaint and refunded £48.13 in fees and agreed to delete the account from his credit file once the balance was repaid. Mr D sought further action, arguing the balance should be reduced or written off. The ombudsman did not uphold the complaint, finding that Barclaycard's remedial actions were appropriate and that Mr D should repay the borrowed amounts as he had received the benefit of the credit.

The Ombudsman's reasoning

The ombudsman accepted that Barclaycard had already upheld the complaint and taken appropriate action by refunding fees and charges and agreeing to delete the account from the credit file once repaid. The ombudsman considered that this remedy was in line with FOS approach to irresponsible lending complaints. Although Mr D argued the balance should be written off, the ombudsman determined that Mr D should repay the borrowed amounts as he had received the benefit of the credit, and that Barclaycard need not take further action beyond what they had already agreed.
