The Ombudsman's reasoning

The ombudsman reviewed the terms and conditions which permit NewDay to change interest rates at any time with at least 30 days' notice. The letter sent to Mr S on 17 September 2025 provided the required 30 days' notice (effective 24 November 2025) and gave Mr S the choice to opt out by closing the account and repaying at the old rate. NewDay therefore acted in line with the contractual terms and treated Mr S fairly by providing appropriate notice and options.
