Summary
Mr & Mrs A purchased a 12-year-old used car with 99,000 miles through a conditional sale agreement financed by Moneybarn in December 2024. The car required pre-delivery repairs and experienced multiple faults throughout 2025, including timing chain failure and engine replacement, which the dealership repaired. In December 2025, the car broke down with electrical faults and became unusable. Mr & Mrs A complained to Moneybarn that the car was not of satisfactory quality when supplied. The ombudsman found that while earlier faults were present at supply and were repaired, the current electrical faults are age-related deterioration unrelated to previous defects and are not unexpected for a vehicle of this age and mileage. The Ombudsman's reasoning
The ombudsman applied the Consumer Rights Act 2015, which requires goods to be of satisfactory quality. For a used car, satisfactory quality is assessed considering age, mileage, price, and history. While the car had faults before delivery that were repaired, the current electrical faults experienced in December 2025 are not linked to those earlier defects and represent normal age-related wear for a 13-year-old vehicle with over 106,000 miles. The engineer confirmed these electrical issues are not unexpected for a vehicle of this age and mileage. Therefore, the car was of satisfactory quality when supplied.
