The Ombudsman's reasoning
The ombudsman applied the Payment Services Regulations 2017, which establish that customers are liable for authorised payments and firms are liable for unauthorised payments. This response also supported the inference that Mrs K was aware of and agreed to both payments being made, albeit under scammer pressure. HSBC's fraud prevention measures were proportionate, and there was no reasonable prospect of a successful chargeback claim since the money transfer service was genuinely provided.
