The Ombudsman's reasoning

Instead, Wakam offered to renew the policy despite knowing of the misrepresentation, which constituted affirmation of the contract and waiver of its right to avoid it. This created a reasonable expectation in Mr A's mind that the policy was valid. Even if affirmation did not occur as a matter of law, it would be unfair and unreasonable for Wakam to avoid a contract it made clear it was willing to renew. Therefore, Wakam must consider the claim on its merits in accordance with policy terms.
