Summary
Mr P acquired a used 10-year-old car via hire purchase from Oodle in January 2025. Within days he discovered cosmetic damage, and within two weeks the car developed DPF issues. The supplying dealership repaired both issues at no cost within the first six months. In August 2025, over six months after supply, the car became inoperable. Mr P sought to reject the car and cancel the credit agreement. The ombudsman found that initial faults were properly remedied and that the later fault, arising after six months, was not shown to be present at supply or caused by earlier repairs. An independent inspection concluded the car was fit for purpose at sale. The complaint was not upheld.
The Ombudsman's reasoning
The ombudsman applied the Consumer Rights Act 2015, which presumes faults arising within six months were present at supply unless proven otherwise, but shifts the burden to the consumer for faults arising after six months. The initial faults (DPF and cosmetic damage) were identified and repaired within the first six months at no cost to Mr P. The August 2025 fault arose after six months, and Mr P failed to provide evidence it was present at supply or caused by earlier repairs. The independent inspection concluded the car was fit for purpose at sale and the current fault could not have existed at supply given the 5,000+ miles driven.
