The Ombudsman's reasoning

The ombudsman found that while Moneybarn did not carry out proportionate checks, a proportionate check would have shown the agreement was affordable based on Mrs N's multiple income sources, debt repayment obligations, and actual repayment performance. Regarding the undisclosed £800 commission, the ombudsman applied the Supreme Court's Hopcraft test and found it unlikely a court would find the relationship unfair because: (1) there was no discretionary commission arrangement, (2) the £800 was not high relative to the amount borrowed or cost of credit, and (3) no commercial tie existed between the broker and Moneybarn.
